Individuals with Disabilities Education Act

Background

A Federal Education Act that provides:

  • Individual Education Plan
  • Least Restrictive Environment
  • Free Appropriate Public Education
  • Due process
  • Parent Participation
  • Multidisciplinary Evaluations

Who Qualifies

  • Someone who has a Specific eligibility ages (0) 3-21;
  • One of 13 Exceptionalities listed in IDEA; and
  • The disability adversely effects education performance.

Evaluation

  • Must be comprehensive
  • Multidisciplinary
  • Re-evaluation every 3 years
  • Parent permission to test & place

Free Appropriate Public Education

  • Must provide IEP & Related Services
  • Appropriate means one that provides educational benefit for a disabled child

Section 504 of the Rehabilitation Act

Background

  • Civil Rights Act to prevent discrimination
  • Purpose to eliminate barriers in programs & activities that are federally funded

Who Qualifies

  • A person with physical & mental impairments; and
  • The impairment substantially limits 1 or more major life function:
    • Speaking, seeing, walking, thinking, hearing, self-care, bodily functions & more.

Evaluation

  • Information is taken from a variety of sources such as medical or school records
  • Re-evaluation is needed before a change in placement

Free Appropriate Public Education

  • Must provide 504 plans
  • Student usually in general education class
  • Accommodations provided
  • Appropriate means education comparable to those without disabilities

Americans with Disabilities Act

Background

  • A civil rights act to prevent discrimination in all public places
  • Purpose is to eliminate barriers and provide equal access to all services

Who Qualifies

  • A person with a physical & mental impairments; and
  • The impairment substantially limits 1 or more major life function:
    • Speaking, seeing, walking, thinking, hearing, self-care, bodily functions & more.
  • This is a broader definition than 504, because it includes addictions, immune disorders, digestive, respiratory, & neurological conditions.
